I'm on currently on H1b (NO EAD). I'm applying for another job with a different company and came across the below question in thier Job Application. I don't know if the other company is willing to transfer my H1, but I would like to apply and prove myself in the interview.
If hired, can you submit verification of your legal right to work in the U.S.?
Should the answer be YES or NO? Can my current H1 be used as a proof of legal right to work???
I'm also required to acknowledge the below statement as part of the application.
I am aware that, as a condition of employment, if employment is offered, I must be authorized to work in the U.S. and demonstrate that authorization as required by the Immigration Reform and Control Act of 1986.
Appreciate if anyone of you can clarify this.

Once you switched from F1 to H1 your F1 becomes void.
If you can get an approved transfer (don't know form # or name) then you should be good, and don't need another stamp. That is my best "guess".

The expiry date on my F1 visa stamp is in 2011.
I intend to convert from H1 to F1 . Do I require a new F1 visa stamp or will my old stamping be valid still?

Applied for my AOS few weeks back. Once I get my EAD, Can I switch from H1B to EAD and continue working for same GC Sponser in case I am not able to find a job on H1B visa.

Hello,
I am in my 6th year H1B which is getting expired on Feb 20th 2007. My I140 is approved couple of months back. My employer has applied for the H1B Extension for 3 years on Jan 8th. According to the current status, I will not get my H1B extension papers until March 2007.
My work contract with the client is getting over by Feb 28 and the chances of extension are almost zero. Since my relation with my employer is on a contractual basis, any thing can happen once my work contract is over.
Question 1:
How does it work if I loose the job before the approval of my H1B (I will have the receipt notice) and also I have to change the employer at the same time?
Can some one let me know about this?
Question 2:
Due to the above confusion, I am debating with me, should I file the H1B extension in premium process or not?
The reason for this thought is, if I loose the job I have to search only for the job and need not to worry about the legalities. I simply have to transfer the H1B to the new employer.
What about the expert�s opinion on this?
Any advices on this would be much appreciated.

Hi,
My friend and his family got their GC's approved last week. They also have Canadian GC. My friend is the primary applicant and she is currently in US, but her husband is in India. He did not apply for an advance parole and was planning to re-enter the country using his Canadian GC. Now that his US GC is approved, will there be any issue at the port of entry?

Hi,
I have applied 485 through a lawyer. The lawfirm sold their company to some one else. I was asked to file G28 and I didn't file for G28 yet.
I got a mail saying I was sent RFE n Feb 4th. I haven't received the letter yet. Would the RFE go to lawyer or me?

Hi gurus,
I have question to you. I am July 2007 filer. My EAD and My wife EAD expiring on 09-25-2008. I applied both renewal Yesterday(06-24-2008 -90 days before).
recently My wife moved from H1B and working on EAD ( I am still working on H1B).
1. If we wont get EAD cards in time (i.e. before 09-25-2008). What will be her status after 09-25-2008 ?
2. Can she change back to H4 or can she change back to H1?
Please advice me.

Hi,
Address should be home address which in your friends case would be address in India.
Same applies for the home phone.
I believe you can put tentative travel date for his travel to US. This info is usually used to determine start date for validity of visa.
For last question, I had used name and contact info of graduate adviser/Department Head.

I am planning to apply for NIW based on my HPSA work location.
My attorney is stating that I need to change work contract to 5 years instead of 3 years for the same. According to him, I can add in the contract that this extention of contract is at discretion of employee after 3 years and it will not damage the interests of my employer.
Since I do not want to work after 3 years with my employer, is this contract language safe for me?
Also is it possible to swelf petition for NIW?

Hi all,
I am currently working on an L1 visa. Have been in the US for 1.5 years.
A few weeks ago I wanted to change my job. Now I have an offer and the new employer is trying to sort out the visa.
Unfortunately, the H1B visas are gone for this year, and the employer can't wait until October to get me working in their team, so waiting for the new H1 visas is not an option.
After checking with their immigration attorneys, they now say the only option I have is to request an 'O' visa (they will support me).
'O' visas are available for top sportsmen, actors or scientists. The attorneys say I have a good-enough resume to apply for one (masters degree, published some articles and experience in top companies) but I still think the opportunities are not many, since I think my resume is really good but not outstanding enough for this type of visa.
My question is, how careful do I have to be when letting the company attorney to apply for a 'O' on my behalf? And specially, if the visa is denied is that going to impact my current L1 visa? I don't wanna end up with no visa at all! And also, is that going to be a 'bad record' next time I apply for a visa (probably H1)?
What about the positive case? Can I have the 'O' visa during the 2 weeks I will still work in my current company under an L1 (I have to give my company 2 weeks notice before leaving) before moving jobs?
I can't stop thinking the attorneys want the best for the company, that doesn't mean they want the best for me, so I am worried about the possibility they are applying for the visa on my behalf but not minding possible bad consequences for me if the visa is refused.
