All,

My 4 years and 2 months on H1B will finish in this November and we are in the process of applying for an extension. I have my 140 approved and waiting for my priority date to become current.

Can I apply for 3 years extension based on my 140 approval? or do I have to apply for 2 yrs extension to finish my 6 yrs first and then eligible to apply for 3 more years (if my priority date is still not current by then?). My HR is under the second impression (2 yrs and then 3 yrs).

Also, please can you specify the USCIS rule under which it is applicable?

You can apply directly for a 3 year extension based on your I-140 approval.

Thanks in advance for answering my question:

I have had an EAD from past 2 years, but I also had a valid H1B I was working for company A on H1 and my GC is filed by Company B future employment(and hence the EAD)

- Company A went down last year, so I was laid off, so my H1 lapsed.
- I switched to Company B since I have an EAD through them.
- I am on Company B's payroll currently.
- The company A folks needed help after they were shutdown, I helped and was paid for hours. (doing same and similar work) but not issued a 1099...

Question - I will need to file taxes on those hours, in terms of immigration have I done anything out of ordinary here? I don't know if USCIS and IRS connecected, or I am just being paranoid here?

As you are on EAD nothing wrong is done as for as USCIS is concerned. Just add that income as self employment income you should be fine. Also you can deduct those expenses you made to earn that income.

MSNBC had a news piece on surprise illegal immigrants and looks like they are from India. I was surprised at a shocking 125,000 people have over stayed their visas and have become Illegal. I was worried if such news articles will reflect on our integrity and our image as knowledge workers.

Just a thought....

While we can keep an eye on these articles - these are coming up to counter our efforts.

Lets keep the focus on.

I would only say - IV is for legal immigrants, for those who have maintained legal status and have played by the rules.

Hi JSaradhi,

When you got your renewal for your H1b till 2008, you should have also received a new I-94 card with a new validity on it, probably till 2008. I know this because I also recently got my H1b renewed.

Check with your employer. They should have handed over the new I-94 to you.

My Case as of March 2010:
EB3 (India) applied with company A. PD: June 2004.
Labor approved, I-140 approved.
No EAD. Labor was not approved when EB3 dates became current
First issue of H1B March 2003
Currently have a 3 year H1B extension (beyond 6 years) due to run out in Nov 2011.

My Questions:
1. I am still working with Company A. Can I move to Company B, i.e. will I be able to transfer my H1B, which is now in its 8th year? If yes, will the transfer be valid till Nov 2011?
2. If I can move to Company B, do I have to file for a new GC right away? If not, by when?
3. Can this new GC be EB2 with the hope of porting the PD from my EB3 case from Company A? If yes, what is the criteria for such a port?
4. Anything else I should keep in mind if I can and do decide to switch to Company B?

All your help is greatly appreciated!! I have been sitting and just waiting for my EB3 to get current, which does not seem like a possibility now. Hoping that I can use an EB2 case.

People are posting questions repeatedly without bothering to spend a few mintues searching previous threads for solutions.

No question is new on IV. Every question has already been answered multiple times, by several people and in great detail. Use the search feature and avoid redundancy. For example,

Should the job title for PERM labor filing be in Job Zone 5 to qualify under EB2 category? Or could one apply in Job Zone 4 and still qualify for a EB2? Also, does having an MBA, exempt a person from EB quota under any of the proposed bills like STEM, SKIL, PACE, TALENT or should it have to be an MS in Engineering.
A quick response would be greatly appreciated.

Yesterday I was catching up with a Dutch friend from Sydney, who's enjoying a holiday in The Netherlands. When I asked him how he was doing, he told me that he had just passed a major crossing in his life, which was revealed by the leadership coach I had introduced him to last year.

His coach had made him realize that he was spending most of his time and energy on his work and even more importantly; that he had lost his focus on living a healthy and valuable life... He got up with work on his mind, he went to bed with work on his mind and even in his sleep he thought of his work... Instead of a corporate athlete he had become a corporate slave...

This must sound familiar to a lot of you because apparently as many as 50 per cent of people bring their work home with them regularly, according to research out of the University of Toronto that describes the stress associated with work-life balance and the factors that predict it. The researchers measured the extent to which work was interfering with personal time and asked participants questions like:

• How often does your job interfere with your home or family life?
• How often does your job interfere with your social or leisure activities?
• How often do you think about things going on at work when you are not working?

So, how do YOU answer these questions?Are you balanced and stress-free enough?

The researchers found several surprising patterns: People who are well-educated, professionals and those with job-related resources report that their work interferes with their personal lives more frequently, reflecting what the researchers refer to as 'the stress of higher status'. While many benefits undoubtedly accrue to those in higher status positions and conditions, a downside is the greater likelihood of work interfering with personal life.

From Slave to Athlete
There are a lot of useful insights and lessons learned to be found in the article 'The Making of a Corporate Athlete', written by Jim Loehr and Tony Schwartz for the Harvard Business Review. I've heard it's one of the most popular HBR articles ever!

In their article they conclude that if there's one quality that executives seek for themselves and their employees, it's sustained high performance in the face of ever-increasing pressure and rapid change. But the source of such performance is as elusive as the fountain of youth! Management theorists have long sought to identify precisely what makes some people flourish under pressure and others fold. Authors Loehr and Schwartz maintain the view that they have come up with only partial answers: rich material rewards, the right culture, management by objectives.

The problem with most approaches, Loehr and Schwartz believe, is that they deal with people only from the neck up; connecting high performance primarily with cognitive capacity. In recent years there has been a growing focus on the relationship between emotional intelligence and high performance. A few theorists have addressed the spiritual dimension: how deeper values and a sense of purpose influence performance. Surprisingly almost no one has paid any attention to the role played by physical capacities.
A successful approach to sustained high performance, Loehr and Schwartz have found, must pull together all of these elements and consider the person as a whole. Thus, their integrated theory of performance management addresses the body, the emotions, the mind, and the spirit. They call this hierarchy the performance pyramid. Each of its levels profoundly influences the others, and failure to address any one of them compromises performance.

High-Performance Pyramid

The Corporate Athlete approach has its roots in the two decades that Jim Loehr and his colleagues at LGE Performance Systems spent working with world-class athletes. In the early nineties Loehr and Schwartz began to develop a more comprehensive version of these techniques for executives facing unprecedented demands in the workplace. In effect, they realized, these executives are “corporate athletes.” If they were to perform at high levels over the long haul, Loehr and Schwartz posited, they would have to train in the same systematic, multilevel way that world-class athletes do. They have now applied their model on thousands of executives around the globe. The executives dramatically improved work performance and they enhanced their health and happiness!

 

Corporate Athlete Rules

1. Launch each day by revisiting your personal and professional mission in life, reconnecting to your deepest values and beliefs.
2. Establish concrete physical, emotional, mental and spiritual objectives.
3. Develop mental preparation and visualization rituals to sustain high-level performance under stress. Example: Like an athlete before a competition, carefully rehearse desired actions before an important meeting.
4. Institute precise personal recovery rituals to decompress and renew energy every 90 to 120 minutes. Example: Have something to eat or do deep breathing exercises.
5. Perform a highly specific exercise routine at least three to four times a week that expands physical capacity and stimulates mental and emotional recovery.
6. Stabilize blood sugar and energy levels by consuming five to six nutritious small meals and 48 to 64 ounces of water daily.
7. Be consistent on sleep patterns, focusing especially on going to bed and waking up early.
8. Implement clearly defined rituals for positively connecting with co-workers to facilitate more effective communication and leadership. Example: Take opportunities to compliment a worker each day.
9. Build effective rituals for truly separating work life from personal life. Example: Take a walk or work out to decompress before leaving work for home.
10. Conclude each day by holding yourself accountable for the progress made in achieving your desired mission and behaving consistently with your deepest values.

Countries With the Best Work-Life Balance
In case you're out of balance, what would be the best country in the world to achieve the ultimate work-life balance? Based on data from 34 countries, the OECD chose three indicators to measure work-life balance. These include a.) the amount of time devoted to personal activities, b.) the employment rate of women with children age 6 to 14 and c.) the number of employees working over 50 hours a week.

• Not surprisingly, Northern European countries fared better when it came to leaving the office on time. For instance, the Netherlands and Sweden both only have 0.001% of their respective populations regularly working over 50 hours a week.
• As for working mothers, the best country to live is Denmark, where 78% of mothers jump back into the workforce after their kids head to school. Turkey is at the other end of the spectrum, with only 24% of women with children also holding down a paying job.

Since AC21 does not go in any official USCIS form, it is better to attach with G-28. My attorney did that and USCIS had acknowledged their receipt of the G-28 and supporting documents. The Ack was a letter to me and the attorney when my (new) attorney opened a service request inquiring the attorney of record after 4 weeks of filing G-28 and AC21 documents.

Hello all,

Anyone who has knowledge in the following can reply back to me.

Mother 10 years Multiple visa will expire in May 5th of this year, questions:

1. What is the last date she can travel with this Visa?

2. She overstayed her trip in 1998 by 2 yrs and came back 3 times after that trip without any issues at POE and did not O/S her time in 2006 twice and in 2007 , what complication would she have at the Trinidad (Caribbean) Embassy for renewal visa ?

3. Would they ask about the first trip and why she O/S ? not sure since she made 3 trips after and had NO issue at POE.

4. Should I go with her for the visa renewal, since I could explain better if this questions comes up ? I have her regular Dr. letter and medical record showing that she was I'll and was seeing him, but not from the hospital.

The reason she O/S in 1998 is due to emergency surgery 15 days before her return date so she was ill and couldn't go back until she feel well which she did and went back on in 2001.

Hi,

I have spent over 3 years in US. Can I file for H1B extension based on 6 years window for H1B visa. My situation is I am in India and the company is filing this fro me in US.
What are the chances of getting this extension approved?

1. I have maintained a legal status for 3 years during my stay in US.
2. 221g was the problem I couldnt get back to States.
3. 221g got cleared but my I 797 got expired and old company withdrew H1B extension.
4. Now one company is helping me with H1B extension based on my case as detailed above.

Pls advice about the possibility of getting this H1B extension. I am kind of waiting on this for long.

3. Can I port my PD (As I have approved I140 with Employer A) to my GC process with Employer B?

(this is not to say we have not had good quality local people for the job as well)

We are a canadian family who moved to the US about 10 years ago. We are US permanent residents; all have green cards. My husband lost his job in the US last month and we are currently staying with family in Canada until my husband gets another job. But this other job may be in Canada or in the US again. Until he gets an answer and we relocate, we would like to put our children in school so they don't fall behind by the time we get to our next destination - which could be about another month or so. If we place our children in canadian schools until then, will this jeopordize our green card or status?

If appropiate can one of the administrators tell us how much of the funds collected thus far have been used (for whatever purposes). I am not asking where the money went :-), just basically how much is left in the Kitty now. If we are running low i am hoping we will see a spur of new donations..

I know a lot of July 2nd filers and some other who have been waiting for receipt notices...

There was an update yesterday by Mathew at www.immigration-law..that of the 800,000 applications only 400,000 have been receipted so far....May be it may take 2 more months for all the receipting updates to be done....

So everybody who is frustrated ..hang in there..have patience

10/11/2007: July VB Fiasco I-485 Receipting Delays

The USCIS has yet to release the detailed progress report on the receipting delays in terms of the numbers that have yet to be processed for receipting. The only thing people know through various private websites just indicates that there are a plenty of people who are still waiting for filing fee checks cashed or receipt notices received for the cases which were filed as early as July 2, 2007, not to mention any later cases.
We reported earlier that the USCIS had allegedly received total of 800,000 cases for the July VB fiasco cases. There is an unconfirmed report that they have completed the receipting only half way through of the total, meaning approximately 400,000. There are no sources of information to verify or confirm the figures. However, if it is correct, the USCIS has yet to process mountains of receipting workloads ahead and the filers have some additional sleepless nights which they will have to endure for a while. AMEN!

I don't think anybody ask for an EVL at POE! And even if they ask, there are no 'format' requirements. If you want, you can just take a standard EVL mentioning your salary, duration of work and title - that should be it.

as per the old messages about the docs to be taken while travelling in AP, EVL was also mentioned in this forum
